These Terms and Conditions of Use relate to the rules that must be observed by you when accessing or using the functionalities of the website https://www.fasano.com.br. As a condition for access and use of the exclusive features of the site, you declare to be over 18 (eighteen) years old and that you have read this document and the Privacy Policy in full and carefully, being fully aware and thus freely agreeing to the terms stipulated herein. By browsing the site and using its functionalities, you accept and agree to the Terms and Conditions of Use that are in effect on the date of your access.
RESPONSIBILITIES OF THE FASANO GROUP
1.1. The site and its functionalities are presented to you as they are available, and may undergo constant improvements and updates. The Fasano Group is committed to:
a) Preserving its functionality, with unbroken links and using a layout that facilitates usability and navigability whenever possible;
b) Displaying the functionalities clearly, completely, accurately, and sufficiently so that there is an exact perception of the operations carried out; and
c) Protecting, through available state-of-the-art technology, the data collected by the provided functionalities.
1.2. The Fasano Group makes the best efforts to maintain continuous and permanent availability of the site. However, temporary unavailability may occur due to necessary maintenance or even due to force majeure, such as natural disasters, failures in communication systems and internet access, or third-party actions that are beyond the sphere of surveillance and responsibility.
1.2.1. If this occurs, the Fasano Group will do its utmost to restore access to the site as soon as possible, within the technical limitations of our services and third-party services on which we depend to stay online.
1.2.2. The Fasano Group reserves the right to change the established rules and criteria, types of services provided, companies responsible for their intermediation, and anything else it deems necessary for the proper functioning of the site.
1.3. You do not have any right to demand the availability of the Fasano Group nor can you claim compensation or damages if the site remains offline, regardless of the reason.
1.4. The Fasano Group is not responsible for:
1.4.1. Any problems, bugs, glitches, or improper functioning that may occur on your devices and equipment and are directly or indirectly resulting from regular use of the site.
1.4.2. Any direct or indirect damage caused by third-party events, such as, but not limited to, hacker attacks, system failures, server or internet connection failures, including actions of software that may, in any way, damage your physical or logical assets or your connection due to access, use, or navigation on the site, as well as the transfer of data, files, images, texts, audios, or videos contained therein.
1.4.3. Your navigation on external links eventually provided on the site, it is your duty to read the Terms and Conditions of Use and Privacy Policy of the accessed third-party service.
1.4.4. For verifying, controlling, approving, or guaranteeing the adequacy or accuracy of the information or data made available on such links, therefore not being responsible for damages or losses incurred by visiting such sites, it is your responsibility to verify the reliability of the information and data displayed there before making any decision or taking any action.
YOUR RESPONSIBILITIES
2.1. You are responsible and undertake to:

2.1.2. Provide correct, complete, and updated registration and payment data, as well as inform a contact channel capable of being activated by the Fasano Group for the proper provision of services. If at any time it is found that you provided false or inconsistent data, the Fasano Group reserves the right to suspend or cancel your Access Account, without prejudice to taking any measures it deems appropriate.
2.1.3. Maintain the confidentiality of your Access Account data, especially your login and password, in relation to third parties and use it individually and non-transferably, not providing, disclosing, or sharing your password or any authentication mechanism with anyone, including on Platforms offered by third parties. If you suspect that the confidentiality of your password has been violated, you must change or update it as soon as possible or contact the available customer service channels.
2.1.4. Acknowledge that all accesses and operations performed after your successful digital authentication are interpreted as being your responsibility incontestably, including those derived from misuse or disclosure thereof to third parties.
2.1.5. Set up your anti-spam systems, similar filters, or message redirection settings so that they do not interfere with the receipt of communications and materials from the Fasano Group, and no excuse will be acceptable if you have not had access to any email or electronic message due to the mentioned resources.
2.1.6. Respect all intellectual property rights owned by the Fasano Group, including all rights relating to third parties that may be, or have been, in any way available there.
2.1.7. Do not access areas of site programming, its database, source codes, or any other set of data available in the environment.
2.1.8. Do not perform or allow reverse engineering, nor translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, lend, distribute, or otherwise improperly dispose of the site’s functionalities.
2.1.9. Do not use software for automation of accesses on the site, as well as mining software or automated data collection, of any type or kind, in addition to any not typified here that acts in a similar way.
2.2. In the event of damage to the site or third parties, you are responsible and undertake to bear all obligations to indemnify the injured party, including those whose origin is from acts performed through your Access Account, assuming the passive pole of judicial action or administrative procedure and requesting the exclusion of the Fasano Group, and must fully bear the expenses and procedural costs, leaving it free from losses and burdens.
2.3. The Fasano Group has the faculty to refuse to grant, suspend, or cancel your Access Account if you use the site fraudulently, violate or attempt to violate these Terms and Conditions of Use, the Privacy Policy, or any other right of the Fasano Group.

3.2. The Fasano Group may use all communication channels provided and authorized by you, in their various modalities, including but not limited to email, telephone call, SMS, or any other form of instant electronic message.
3.3. The responsibility for receiving communications and notifications is solely yours, so it is essential that you always provide correct and accurate data and keep it updated.
PROTECTION OF YOUR PERSONAL DATA
4.1. The Fasano Group has its own document, called the Privacy Policy, which regulates the treatment of data collected on the site, being an integral and inseparable part of these Terms and Conditions of Use.
COPYRIGHTS AND INTELLECTUAL PROPERTY
5.1. The commercial use of the expression “Fasano Group”, or even of words that resemble these, but with differentiated spelling, such as trademarks, trade names, or domain names, in addition to the contents of the site screens, as well as computer programs, databases, networks, and their files, are owned by or licensed to the Fasano Group and are protected by international laws and treaties for the protection of intellectual property, including, but not limited to, Federal Laws 9.609/98, 9.610/98, 9.279/96, and 10.406/2002.
5.2. No element found on the site may be copied, reproduced, modified, reedited, uploaded, altered, transmitted, or distributed in any way or form, in whole or in part, without the prior and express authorization of the Fasano Group.
5.3. By accessing the site, you declare that you will respect all intellectual property rights of the Fasano Group, including, but not limited to, computer programs, copyrights, and industrial property rights over trademarks, logos, patents, domain names, corporate names, and industrial designs, possibly deposited or registered in the name of the Fasano Group, as well as all rights relating to third parties that may be, or have been, in any way, available on the site, and its infringement may lead to the blocking of your Access Account at the discretion of the Fasano Group, in addition to subjecting you to the payment of damages and losses judicially determined.
MODIFICATIONS TO THESE TERMS AND CONDITIONS OF USE
6.1. These Terms and Conditions of Use are subject to constant improvement and enhancement. Thus, the Fasano Group reserves the right to modify them at any time, according to its purpose or convenience, as well as for the adaptation and legal compliance of a law or regulation provision that has equivalent legal force, and it is up to you to check them whenever accessing the site.
6.2. If updates are made to this document, the Fasano Group will notify you through the available tools on the site.
6.3. The tolerance of any non-compliance with any provision in the Terms and Conditions of Use will not constitute novation of the obligations stipulated herein, nor will it prevent or inhibit the enforceability thereof at any time.
6.4. If any provision of the Terms and Conditions of Use is deemed unenforceable or ineffective, the remainder of the document will continue in force, without the need for a declaratory judicial measure.
GENERAL PROVISIONS
7.1. In case of any discrepancies between the provisions in the Terms and Conditions of Use, the Privacy Policy, or any other document on the site, the one described in the most specific norm shall prevail.
7.2. You must bear the necessary means to navigate the site, including possessing adequate equipment for access, as well as hiring a telecommunications service provider to provide an internet connection.
7.3. You acknowledge that all communication made by email, electronic message, or SMS (to the addresses informed in your registration) is also valid, effective, and sufficient for the disclosure of any matter related to the services provided by the Fasano Group, as well as the conditions of its provision or any other matter addressed therein, except for expressly different provisions provided in the Terms of Use.
7.4. All records and data storage made on the site will be made and cataloged based on the official Brasília time.
7.5. The Terms and Conditions of Use will be interpreted according to Brazilian law, in the Portuguese language, and the Court of São Paulo is elected to settle any dispute or controversy involving this document, except for specific personal, territorial, or functional competence reservation by the applicable law.
GLOSSARY
For the purposes of this document, the following definitions apply:
Anti-Spam: System that prevents unwanted correspondence, such as mass advertising, by blocking messages or moving them to a specific folder.
Bugs: Used when a logical flaw prevents the execution of an operation on the site.
Access Account: Credential necessary to use or access the exclusive functionalities of the site.
Glitches: Used to designate an unexpected operation that prevents the execution or proper functioning of the intended operation on the site.
Layout: Set comprised between appearance, design, and site flows.

POLICIES
Cancellation Policies
Non-Refundable Rates:
The reservation cannot be canceled and/or changed. In case of no-show, the total value of the accommodation is charged. There is no refund of the already paid amount.
Flexible Rates:
When the payment method for your reservation is direct payment at the hotel, it must be guaranteed through the credit card. In this case, there will be a pre-charge of the first night, 6 days before check-in, on the credit card provided for guarantee, and the remaining nights will be paid directly at the hotel. For reservations with flexible rates where the payment method is with a credit card, the nightly rates will be debited at the time of booking. For reservations with a Non-Refundable policy, 100% of the advanced value is debited, and in these cases, it is non-refundable.
Furthermore, at check-in, a security deposit or debit authorization on the credit card will be required to guarantee payment for the accommodation values or any services consumed on-site. This procedure will be required of the guest even if the payment has been made by a third party.

Packages may have different conditions.
We do not accept checks as a form of payment.
Right of Withdrawal:
The Right of Withdrawal refers to Article 49 of Law 8.078/90 of the Brazilian Consumer Protection Code (CDC). This law allows the consumer to withdraw from a contract within 7 days and receive a full refund of any payments made. This applies to payments made for both products and services – including accommodation reservations.
General Policy
Early check-in and late check-out subject to availability, with prior consultation.
It is mandatory, at check-in, to present the same credit card used in the purchase, as well as the original photo ID of the cardholder (ID, Work Card, or Driver’s License).
Furthermore, at check-in, a security deposit or debit authorization on the credit card will be required to guarantee payment for the accommodation values or any services consumed on-site. This procedure will be required of the guest even if the payment has been made by a third party.
One child up to 12 years old accompanied by 2 paying adults will be complimentary in the same room, according to its capacity. Check available categories for this accommodation.
In the case of more than one child up to 12 years old, 25% of the daily rate is charged.
The presentation of the guests’ (adult and minor) identity document (ID) is required at check-in. According to the Child and Adolescent Statute, if the minor is not accompanied by the parents, it is necessary to submit a written authorization from both parents at check-in, with the signatures duly recognized by a notary public along with the minor’s ID.
In accordance with decree 6022 of January 22, 2007, on the Public Fiscal Scripting System (SPED) Project, the completion of data such as full name, CPF, RG, and address is mandatory at check-in
